Item I. Call To Order

A. Judge Gary W. Moore Called to Order the meeting of the Boone County Fiscal Court.

B. Judge Gary W. Moore presented the Invocation and the Pledge to the Flag.

Item II. Approval Of Minutes

A. Judge Moore presented the Minutes from the September 19, 2017 Fiscal Court Meeting for approval. Commissioner Kenner moved, seconded by Commissioner Walton, to approve the Minutes from the September 19, 2017 Fiscal Court Meeting, with no changes. Judge Moore called for a vote on the motion, Motion Passed Aye 4-0.

Item III. Presentations

A. Judge Moore stated there were no Presentations at this time.

Item IV. Personnel matters

A. Judge Moore asked the Fiscal Court Clerk to read into the record Item IV. A: A Resolution Relating To The Boone County Fiscal Court authorizing The Appointment, By Gary W. Moore, County Judge/Executive, Of Austin Kresser To A Part-Time Position For The Boone County Emergency Management Department. Lori Zombek, Director of Human Resources, commented this is to fill a vacant position. Commissioner Walton moved, seconded by Commissioner Flaig, to approve the Resolution, Judge Moore called for a vote on the motion, All Present Voting Aye 4-0.

B. Judge Moore asked the Fiscal Court Clerk to read into the record Item IV. B: A Resolution Relating To The Boone County Fiscal Court Authorizing The Appointment, By Gary W. Moore, County Judge Executive, Of Phil Beetem To The Part-Time Position Of Commercial Plans Examiner Level Ii For The Boone County Building Department. Lori Zombek, Director of Human Resources, stated this is a change from seasonal to part time with no impact on the budget. This position is needed to meet the demands of the Department. Judge Moore commented on the experience that Phil has. Commissioner Kenner moved, seconded by Commissioner Flaig, to approve the Resolution. Judge Moore called for a vote on the motion, All Present Voting Aye 4-0.

Item V. Ordinances

A. Judge Moore asked the Fiscal Court Clerk to read into the record the Second Reading of Item V. A: An Ordinance Relating To The Boone County Fiscal Court Enacteng And Adopting Supplement 2017 S-20 To The Code Of Ordinances For The County Of Boone, Kentucky. Judge Moore explained this is the annual codification of all Ordinances, just a housekeeping item. Commissioner Walton moved, seconded by Commissioner Kenner, to approve the Ordinance. Judge Moore called for a vote on the motion, All Present Voting Aye 4-0.

B. Judge Moore asked the Fiscal Court Clerk to read into the record the Second Reading of Item V. B: An ordinance Relating To The Boone County Fiscal Court amending Ordinance 1401, Adopted On December 17, 2013 By Modifying The Fee Schedule Of The County's Alcoholic Beverage Control And Licensing Regulations. Judge Moore commented this change will make the County more business friendly for businesses that just operate in the summer months, not a full year; it is a cost benefit for them. Commissioner Flaig moved, seconded by Commissioner Kenner, to approve the Ordinance. Judge Moore called for a vote on the motion, All Present Voting Aye 4-0.

Item VI. Judge's Report

A. Judge Moore stated there were no Reports at this time.

Item VII. Administrative Matters

A. Judge Moore asked the Fiscal Court Clerk to read into the record Item VII. A: A Resolution Relating To The Boone County Fiscal Court Acknowledging Support For The Submission Of A Federal Infra Transportation Grant By The Kentucky Transportation Cabinet And Further Committing Local Funding Support as Part Of The Grant Application. Judge Moore explained this is a new federal grant for local transportation projects such as Mt. Zion and Richwood interchange improvements. The cost of these improvements is estimated at $15oM. Boone will contribute $2.5M to the project if the Grant is awarded. The application is due November 2, 2017. Jeff Earlywine, County Administrator, explained the forecast and how the TIF Districts were involved. Judge Moore asked if there were any questions, one presented. Commissioner Kenner moved, seconded by Commissioner Flaig, to approve the Resolution. Judge Moore called for a vote on the motion, All Present Voting Aye 4-0.

B. Judge Moore asked the Fiscal Court Clerk to read into the record Item VII. B: A Resolution Relating To The Boone County Fiscal Court Approving The Execution Of An Mou With The Boone County Local Board Of Health, The Boone County Public Library, The Boone County Cooperative Extension District, The Boone County School District, The Boone County Planning Commission And United Way Of Greater Cincinnati Collectively Referred To As Partners Of Boone County Success By 6. Judge Moore stated this is an update on the Memorandum of Understanding with all partners for Success By 6. Many County employees are involved with this program, Lori Zombek, Laura Pleiman and David Whitehouse. Commissioner Kenner moved, seconded by Commissioner Walton, to approve the Resolution. Judge Moore called for a vote on the notion, All Present Voting Aye 4-0.

C. Judge Moore asked the Fiscal Court Clerk to read into the record Item VII. C. A Resolution Relating To The Boone County Fiscal Court Allocating Mental, Health Tax Funds To The Northern Kentucky Area Development District To Provide Program Support For The Northern Kentucky Regional Helpline. Matthew Webster, Assistant County Administrator, explained a partnership was created to support the helpline for substance abuse. It is a much needed service which received over 1,3oo calls over the first year. The County will be contributing $24,892 to NKAEDD that holds the funding for this project. Judge Moore stated the phone number needed to be protected as it has been advertised. This is not a switchboard but 24/7 counseling. St. Elizabeth finances 5o% of the cost and the three Counties the other 50%. Commissioner Kenner moved, seconded by Commissioner Walton, to approve the Resolution. Judge Moore called for a vote on the motion, All Present Voting Aye 4-0.

D. Judge Moore asked the Fiscal Court Clerk to read into the record Item VII. D: A Resolution Relating To The Boone County Fiscal Court Awarding The Bid For Nine (9) Recycling Department. Scott Pennington, County Engineer, stated only 1 bid was received. Commissioner Kenner moved, seconded by Commissioner Flaig, to approve the Resolution. Judge Moore called for a vote on the motion, All Present Voting Aye 4-0.

Item VIII. Fiscal matters

A. Judge Moore presented the Invoice Report dated September 3rd, 2017 and pre-paid Invoice

Reports dated September 21st and 28th, 2017. Commissioner Flaig moved, seconded by Commissioner Walton to approve the Invoice Reports. Judge Moore called for a vote on the motion, All Present Voting Aye 4-0.

B. Judge Moore presented the Golf Invoice Report dated September 3rd, 2017 and the pre-paid Golf Invoice Reports dated September 21st and 28th, 2017. Commissioner Kenner moved, seconded by Commissioner Flaig to approve the Golf Invoice Reports. Judge Moore called for a vote on the motion, All Present Voting Aye 4-0.

C. Judge Moore presented the Treasurer's Interfund Transfer Report ending August 31, 2017. Commissioner Walton moved, seconded by Commissioner Flaig to approve the Treasurer's Interfund Transfer Report for August. Judge Moore called for a vote on the motion, All Present Voting Aye 4-0.

Item IX. Old Business

Judge Moore stated the Staff wanted to report on the Historic Courthouse project. The County wants to provide a valuable community space along with protecting the asset. Water damage on the inside was taking a toll on the building. Matthew Webster, Assistant County Administrator, stated the number one goal was to protect the building and also create a scheduling policy. The project is in final stages of putting the building back to its original character. There have been some cost overruns around $10o,ooo due to the age of the building. The County will receive $147,ooo in historic tax credits upon completion of the project. The Staff will bring back to the Court a draft policy/procedures document that allows modest charges for use of the building. Plan for mid-November ribbon cutting. Jeff Earlywine, County Administrator, stated there may be 1 change order at the end for a very small increase, if needed. Judge Moore added there is an elevator in the building Flow, making it handicap accessible.

Judge Moore asked if there was any other Old Business to come before the Court, none presented.

Item X. New Business

Judge Moore stated there was a New Business item to come before the Court. The County received a Notice from UPS requesting delivery by golf carts in residential areas. Judge Moore explained that the Legislature passed a law to allow delivery of packages in residential areas by golf carts from a POD. Jeff Earlywine, County Administrator, commented this will be through the heavy delivery season of October through January. There are baseline requirements that must be met. Judge Moore stated he was in favor of watching the process for one season, then creating standards if needed. Commissioner Flaig asked a question about liability, Commissioner Walton asked about security, Jeff Early wine responded. Judge Moore encouraged the Commissioners to review the State Law that was passed. No further action on this matter.

Judge Moore introduced the Scout Troop that was in attendance, Troop #836.

Jeff Early wine presented pictures of the new walking bridge that has been installed at Middle Creek Park.

Announcements:

Judge Moore announced the Bean Bash would be held this weekend at a new location, the SETEC Center, Saturday, October 7th.

Item XI. Closed Executive Session

A. Judge Moore announced that the Court would be going into Closed Executive Session to discuss pending and proposed litigation involving the County per KRS 61.810(1)(c). There would be no further action taken by the Court. Judge Moore called for the Court to come out of Closed Executive Session. Commissioner Kenner moved, seconded by Commissioner Flaig, to end Closed Executive Session. All Present Voting Aye 4-0.

Item XII. Adjournment

Judge Moore called for adjournment of the Fiscal Court Meeting. Commissioner Kenner moved, seconded by Commissioner Flaig, to adjourn the meeting. All Present Voting Aye 4-0.
