Peoria County Board - Land Use Committee met Sept. 14.

Call to Order:

Mr. Rosenbohm called the meeting to order at 5:04 p.m.

Approval of Minutes:

A motion to approve the Land Use Committee minutes from July 24, 2023 was made by Ms. Daley and seconded by Dr. Blair. A vote was taken on the motion and carried. (8-0)

Zoning Cases:

ZBA-2023-0030, Petition of Ronald Porter and Sue Graves

Ms. Williams made a motion to approve the rezoning request and was seconded by Ms. Daley.

Ms. Urban summarized the case. A rezoning request from “R-2” Medium Density Residential to “R-R” Rural Residential. The petitioners request to rezone a 1.467-acre parcel from “R-2” Medium Density Residential to “R-R” Rural Residential. The petitioners own both the subject parcel which contains a rental house and the adjacent parcel to the east which contains their permanent residence and is zoned Rural Residential. The petitioners wish to adjoin the approximately 0.467-acre timbered northern portion of the subject parcel with the parcel to the east which contains the residence. The zoning classifications must be the same in order for the adjacent property to be combined. The remaining 1-acre with the rental house would be sold to a family member. The use of both properties will remain the same. There are 0 consents and 0 objections on file.

The subject parcel is located on West Nagel Road in Hollis Township. An existing easement allows approximately 168 feet of shared driveway off West Nagel Road and will continue to serve both parcels. Adjacent parcels on three sides are zoned “R-2” Medium Density Residential and “R-R” Rural Residential and are being used residentially.

The request is consistent with the surrounding residential uses and zoning classifications as well as the standards in the “R-R” zoning district. The property has an existing septic system and public water. The request is consistent with the Peoria County Comprehensive Land Use Plan designation of Urban. Staff recommended approval and the Zoning Board of Appeals concurred unanimously.

ZBA-2023-0033, Petition of Theresa M. Holshouser

Dr. Blair made a motion to approve the special use request and was seconded by Mr. Windish.

Ms. Urban summarized the case. A Special Use as required in Section 20-6.2.1.1.b of the Unified Development Ordinance. The petitioner requests to divide an existing 17.956-acre parcel into tracts of approximately 5-acres, 5-acres, and 7.956-acres in order to settle an estate amongst family members. The parcel consists of a machine shed, cattle shed, single-family dwelling, and agricultural field. The petitioner is proposing to split tracts in order to separate the agricultural uses from the existing single-family dwelling. The cattle shed and the machine shed would be located on the northern proposed 5-acre tract, and would continue to be farmed. The single-family dwelling would be located on the southern proposed 5-acre tract, and the remaining 7.956-acres would be added to the existing adjacent parcel to the south. There were 0 consents and 0 objections on file.

The subject parcel is located on North Evans Mill Road in Radnor Township. Both 5-acre parcels will retain frontage on North Evans Mill Road. The 7.956-acre tract will be added to the petitioner’s existing 2-acre parcel and will not be a separate building parcel. The parcel is zoned “A-1” Agricultural Preservation, along with all surrounding properties. Surrounding land uses include single-family dwellings and agriculture, with many parcels ranging between 5 and 11 acres. The request is consistent with the surrounding area. The subject property is served by a private septic system and an existing shared well located on the petitioner’s adjacent property to the south.

The request is consistent with the Peoria County Comprehensive Land Use Plan designation of Agriculture and would allow the petitioner’s family to continue farming while preserving the farmland. Staff recommended approval and the Zoning Board of Appeals concurred unanimously.

A vote was taken on the motion and carried (8-0).

ZBA-2023-0035, Petition of Peoria County

Mr. Windish made a motion to approve the Text Amendments and was seconded by Ms. Williams.

Mr. Braun advised that battery energy storage systems is an emerging technology becoming more prevalent in Central Illinois due to the closure of the Edwards Power Plant, and the proposed text amendments establish battery energy storage systems as a Special Use. The Unified Development

Ordinance currently does not define battery energy storage systems, nor are they permitted as a Special Use and Mr. Braun stressed the importance of the addition of the Use into the Ordinance to allow for potential development within Peoria County.

Mr. Braun summarized the proposed text amendments to the Unified Development Ordinance, Chapter 20 of the Peoria County Code. These are text amendments to Article 5, Sections 5.2, 5.10, and 5.11 (Special Use regulations); Article 6, sections 6.3, 6.11, and 6.12 (Bulk Regulations); Article 7, Sections 7.4 and 7.6 (Fences, Landscaping and Bufferyards); a new section 7.19 (Battery Energy Storage Systems); and Article 11, Section 11.1 (Definitions) of the Peoria County Code.

Battery Energy Storage System are broken down into two Tiers. Tier 1 storage will be under 600 kilowatts, while Tier 2 will be storage systems on a commercial scale. The proposal for the new section of Chapter 20 is for stand-alone battery energy storage systems only, and will be proposed as a Special Use in the “A-2” Agricultural District, and in the “I-1” and I-2” Industrial Districts.

Mr. Braun advised that staff met with potential developers to explain research process and to identify concerns, and noted a letter distributed to Planning & Zoning Department and subsequently distributed to committee members. He stated that staff did work with the group extensively before the amendments were filed. Mr. Dillon remarked that several of the concerns noted in the letter are addressed in the text amendments and zoning processes.

A vote was taken on the motion and carried (8-0).

Resolution:

2023 Peoria County Multi-Jurisdiction Multi-Hazard Mitigation Plan

Ms. Daley made a motion to approve the resolution and was seconded by Dr. Blair.

Ms. Abi-Akar advised that the intent of the Plan is to identify, assess, and mitigate natural and man made hazard risk to better protect the people and the property within Peoria County.

A vote was taken on the motion and carried (8-0).
