City of Peoria Planning & Zoning Commission met Aug. 3.

Here is the minutes provided by the Commission:

Vice Chairperson Mark Misselhorn presiding and with proper notice having been posted.

ROLL CALL

The following Planning & Zoning Commissioners were present: Ed Barry, Eric Heard, Mark Misselhorn, and Richard Unes– 4. Commissioners absent: Michele Anderson, Christopher Triebold, and Mike Wiesehan–3.

MINUTES

Commissioner Barry moved to approve the minutes of the Planning & Zoning Commission meeting held on July 6, 2017; seconded by Commissioner Heard.

The motion was approved viva voce vote 4 to 0.

REGULAR BUSINESS

CASE NO. PZ 17-27

Hold a Public Hearing and forward a recommendation to City Council on the request of Ted Clark for approval of an Annexation Petition and Annexation Agreement, a Preliminary Subdivision Plat, to rezone property from a Class R-3 (Single-Family Residential) District to a C-1 (General Commercial) District, and to obtain a Special Use for Outdoor Recreation for the property located on the eastern side of Orange Prairie Road and addressed as W Grange Hall Rd, Peoria, Illinois. The property is also identified as Parcel Identification No. 08-35-100-033 (Council District 5).

The applicant has requested a thirty (30) day deferral to collect more information in order to respond to neighboring property owner concerns. Staff has no objection to this deferral and the case will be placed on the September 7, 2017 Planning & Zoning Commission Agenda.

With no interest from the public to provide public testimony, Vice Chairperson Misselhorn closed the Public Hearing at 1:05p.m.

Motion: Commissioner Heard made a motion to approve the thirty (30) day deferral request; seconded, by Commissioner Unes.

The motion was approved viva voce vote 4 to 0. Yeas: Barry, Heard, Misselhorn, Unes – 4. Nays: None.

CASE NO. PZ 17-30

Hold a Public Hearing and forward a recommendation to City Council on the request of E.R. Patterson, Jr., of Kingdom Outreach Ministries Inc. for Kingdom Temple Church of God in Christ, to rezone property from a Class R-4 (Single Family Residential) District to a Class CN (Neighborhood Commercial) District for property identified as Parcel Identification Numbers 18-08-417-016 through 18-08-417-018, with addresses of 126 S. Saratoga Street, 921 and 923 W. Smith Street, Peoria, Illinois (Council District 1).

Senior Urban Planner, Kimberly Smith, Community Development Department, read Case No. PZ 17-30 into the record and presented the request. Ms. Smith provided the Summary of Proposal, the Development Review Board Analysis, and Recommendation as outlined in the memo.

The Community Development Department recommended Approval of the request.

Bishop ER Patterson, petitioner, said the rezoning would allow for a development project for Kingdom Outreach Ministries Inc. for Kingdom Temple Church of God in Christ.

Commissioner Unes supported the request.

With no interest from the public to provide public testimony, Chairperson Wiesehan closed the Public Hearing at 1:12pm.

Motion: Commissioner Unes made a motion to approve the Annexation Petition, Annexation Agreement, and the Rezoning request; seconded, by Commissioner Barry.

Vice Chairperson Misselhorn supported staff’s recommendation.

The motion was approved viva voce vote 4 to 0. Yeas: Barry, Heard, Misselhorn, Unes – 4. Nays: None.

CASE NO. PZ 17-31

Hold a Public Hearing and forward a recommendation to City Council on the request of Todd Light of Demonica Kemper Architects, for Mark Bell of EPIC Peoria, LLC, for a Special Use in a Class WHD (Warehouse Form) District to allow for Indoor Recreation - Athletic Club, with Waivers for Building and Architectural Standards, for property identified as Parcel Identification No. 18-09-330-031, with an address of 927 SW Washington Street, Peoria, Illinois (Council District 1).

Senior Urban Planner, Kimberly Smith, Community Development Department, read Case No. PZ 17-31 into the record and presented the request. Ms. Smith provided the Summary of Proposal and Requested Waivers, and the Development Review Board Analysis and Recommendation as outlined in the memo.

The Development Review Board recommended APPROVAL of the requested waivers:

1. Waiver from UDC 6.5.A.3.c. Ground Story Height, to allow an interior height of fifty-two (52) feet. 2. Waiver from UDC 6.5.A.9.b. Buildable Area, to accommodate the climbing gym as proposed. 3. Waiver from UDC 6.6.7.C. Standards, to allow corrugated metal as primary building material, not

accent material.

Approval was recommended, with the following conditions:

1. Provide windows on all sides, particularly from the alley/May Street, Maple Street, and Washington Street. 2. Exterior building materials must meet UDC Section 6.6.1.G. Equivalent or Better.

Commissioner Unes expressed concern for the financial expense of the window installation on all sides of the building, in reference to Condition A. Commissioner Unes supported windows on Washington Street. Commissioner Unes referred to the Hagerty development; in which staff had not imposed conditions.

Ms. Smith noted the Hagerty project was an administrative approval; Case No. PZ 17-31 requested waivers, therefore, staff may impose conditions.

Commissioner Misselhorn suggested Condition A read, “Provide windows on the sides of the alley/May Street, Maple Street, and Washington Street.” Commissioner Misselhorn supported the waiver requests, specifically referring to Waiver C.

In response to Commissioner Barry, Ms. Smith confirmed Condition B was no longer needed due to Waiver C.

Steve Kerr, representing the petitioner, agreed with staff with the exception of the requirement to install windows on Maple Street and May Street. Mr. Kerr noted the alley (May Street) was not maintained as a street.

Todd Light, representing the petitioner, noted the elimination of the requirement to install windows on Maple Street would allow for an additional climbing wall.

Commissioner Heard supported the petitioner’s request to remove the window installation requirement on Maple Street and May Street.

In response to Commissioner Barry’s inquiry, Mr. Light said the first four rows of windows on May Street would remain.

With no interest from the public to provide public testimony, Chairperson Wiesehan closed the Public Hearing at 1:20p.m.

Motion: Commissioner Heard made a motion to approve the Special Use request with waivers and modify Condition A to read, “Provide windows on the Washington Street side;” seconded, by Commissioner Unes.

Commissioner Heard said his main concern was the expense of windows and windows were counterproductive to the proposed use of a climbing gym.

Commissioner Barry supported the window installation on May Street, Maple Street, and Washington Street as it would be aesthetically pleasing and enhance the proposed metal façade. Commissioner Barry supported adding windows as it would complement urban revitalization of the Warehouse District. Commissioner Barry recommended the petitioner consider the back façade in the final design.

Vice Chairperson Misselhorn agreed with Commissioner Barry. Vice Chairperson Misselhorn said he preferred window installation on the three sides to add interest to the interior and exterior of the building. Vice Chairperson Misselhorn said he would support the motion as the use required wall space.

Commissioner Unes suggested the installation of the windows in an alternative location on the May Street side that would allow additional space for a climbing wall and provide an aesthetically pleasing façade.

The motion was approved viva voce vote 4 to 0. Yeas: Barry, Heard, Misselhorn, Unes – 4. Nays: None.

CITIZENS' OPPORTUNITY TO ADDRESS THE COMMISSION

It was determined there was no interest from citizens to address the Planning & Zoning Commission at 1:35 p.m.

ADJOURNMENT

Commissioner Unes moved to adjourn the regularly scheduled Planning & Zoning Commission Meeting; seconded by Commissioner Heard.

The motion to adjourn was approved viva voce vote 4 to 0.

The Planning & Zoning Commission Meeting was adjourned at approximately 1:38 p.m.
