City of Chillicothe Public Safety Committee met Sept. 4.

Here is the minutes provided by the Committee:

The Public Safety Committee met on September 4, 2018 at 4:30 p.m. in the council chambers at City Hall.

Present: Chairman Hughes, Alderman Sharp, Alderman Braun

Others in attendance: Clerk Hurd, Mayor White, Attorney Michael Seghetti, Fire Chief Benisch, Police Chief Mettille, Office Manager Passage

Absent: None

Chairman Hughes called the meeting to order t 4:30pm

BUDGET REVIEW

Office Manager Passage led a review of the budget. She reported that all departments are in-line with expenses.

SPECIAL EVENT REQUEST – ST EDWARD SCHOOL :

Clerk Hurd presented a Special Event Request Held on Public Property from St. Edward Catholic School. St. Edward is requesting the closing of 5th Street at Cedar north to the entrance of St. Edward School for school event on September 15, 2018. St. Edward is asking for the street to be closed from 10:00am to 2:00pm in order for people to safely cross from the school to the vacant lot that the school owns. Police Chief Mettille had no objections. It was the consensus of the committee to seek council approval.

SPECIAL EVENT REQUEST – IVC HOMECOMING PARADE:

Clerk Hurd presented a Special Event Request Held on Public Property from IVC for the annual homecoming parade on 2nd Street. It was the consensus of the committee to seek council approval.

PARKING – SECOND STREET BETWEEN WALNUT AND CHESTNUT:

REVIEW OF FORMAL COMPLAINTS RECEIVED – DANA BANNISTER:

1. Request for Dismissal of Ticket: Chairman Hughes read the request to the committee. Discussion was held. Attorney Seghetti gave information on the definition of a Second Hand Dealer. Mayor White informed the committee that he did not feel any action need to be taken to dismiss and suggested Mr. Bannister go to his hearing date and let the judge decide. Mr. Bannister questioned who enforces the ordinance. Mayor White said it would be the Police Department who enforces.

2. Business Required to have 2nd Hand Dealer License: Chairman Hughes read the complaint from Mr. Bannister stating that Second Hand Dealer License numbers 001, 002, 003, 004, 005, 006,007, 008 009, 10, 012 were in violation. Mayor White asked Clerk Hurd to read the names of the business that held those license numbers. Discussion was held on sec. 70-31 of the city code. It was the advice of the attorney that since the city does not enforce that section of the code it should be reviewed. The consensus of the committee was to review that section of the code at the next Public Safety meeting.

3. Building in direct violation of CB-1 Ordinance: Chairman Hughes read the complaint from Mr. Bannister stating that the building appears to be in direct violation of the CB-1 Ordinance (use of buildings in the CB-1). Mayor White informed the committee the building is owned by Sarah Williamson and that it looks vacant however he has been told by Ms. Williamson that her son operates a business out of there. Mayor White told the committee that he has suggested to her that a sign for the business be placed so that it does not look like a vacant building. Mayor White suggested the attorney draft a letter to the owner asking for a sign to be placed.

4. Building in direct violation of CB-1 Ordinance: Chairman Hughes read the complaint from Mr. Bannister stating that the building appears to be in direct violation of the CB-1 Ordinance (use of buildings in the CB-1) Mayor White informed the committee the building is owned by Jetta Draper and that he has spoken with her. She has told him that she wants to open a store there but needs to fix up the front of the building. Mayor White gave her a façade application however the application states that you have to be in business to apply for the grant. Discussion was held on the condition of the building. It was the consensus of the committee that the property be forwarded to the Fire Chief for a property maintenance review because of the rotting wood and paint peeling.

5. Building in direct violation of CB-1 Ordinance: Chairman Hughes read the complaint from Mr. Bannister stating that the building appears to be in direct violation of the CB-1 Ordinance (use of buildings in the CB-1). Mayor White informed the committee the owner had passed away and the building is vacant. Discussion ensued. There will be no action taken.

6. Building in direct violation of CB-1 Ordinance: Chairman Hughes read the complaint from Mr. Bannister stating that the building appears to be in direct violation of the CB-1 Ordinance (use of buildings in the CB-1). Discussion was held on the property owned by Jeff Anderson. Because of the unclear use of the building it was the consensus was for the Mayor and Attorney to review.

7. Building in direct violation of CB-1 Ordinance: Chairman Hughes read the complaint from Mr. Bannister stating that the building appears to be in direct violation of the CB-1 Ordinance (use of buildings in the CB-1). Discussion was held on the building being used as a warehouse. It was the consensus that the Mayor and Attorney will review and possibly send a letter to Kim Oathout-Ryan, owner of the property.

8. Building in direct violation of CB-1 Ordinance: Chairman Hughes read the complaint from Mr. Bannister stating that the building appears to be in direct violation of the CB-1 Ordinance (use of buildings in the CB-1). Mr. Bannister withdrew this complaint. Mr. Bannister questioned the building structure (post in front).

Mr. Bannister was in the audience and participated in discussion of the complaints.

Attorney Seghetti addressed Mr. Bannisters 2nd FOIA request informing him that the city has no records about the dismissal of his ticket. It was suggested to Mr. Bannister by the Attorney and Mayor to ask for a discussion in regards to the ticket being dismissed because there are no documents to FOIA.

SALE OF POLICE VEHICLES:

Chief Mettille requested that the council put out an invitation to bid for the two squad cars that are no longer in use. It was the consensus of the committee to seek council approval for bids.

Chief Mettille informed the committee that body cams will go live mid to late September.

FIRE UPDATE:

Chief Benisch presented his August report. Report attached.

Chief Benisch announced the Fire Association will be having a pancake breakfast Saturday, September 8th.

PROPERTY MAINTENANCE:

Chief Mettille presented two properties: 1403 N 2nd Street and 1314 N 1st Street. Discussion was held. Chief Benisch was directed to conduct a property maintenance checklist of the two properties.

Chief Benisch presented property maintenance reports on 1405 Finney and 1623 Benedict. The committee reviewed each report. It was the consensuses of the committee to have Chief Benisch send each property owner a Notice of Violation giving the owners 30 days to comply.

OLD BUSINESS

AMENDMENT GOLF CART ORDINANCE – TRAILERS:

Chief Mettille presented an amendment to golf cart trailers. Chief Mettille informed the committee that he is not recommending the ordinance change. Discussion was held on what Illinois State Law prohibits. City Attorney will review the state law and report back to the committee.
