City of Batavia City Council met May 6.

1. MEETING CALLED TO ORDER

The meeting was called to order by Mayor Schielke at 7:00 pm

2. INVOCATION followed by PLEDGE OF ALLEGIANCE

Mayor Schielke offered a brief invocation. Alderman Solfa led the Pledge of Allegiance.

Motion by Ald. Beck seconded by Ald. Solfa to approve the Consent Agenda as presented. Motion carried 12 yea/ 0 nay/ 2 absent.

7. MATTERS FROM THE PUBLIC: (For Items NOT on the Agenda) None.

8. BID OPENING: Sale of Land

Director Buening addressed the council and informed them that this is a bid for property at the Northeast corner of Main & Deerpath Rd. The bid was advertised 3 times in April in the Daily Herald. The city received one sealed bid that Director Buening opened in front of the City Council. Bid from Leo Brown Development Company in the amount of $10.00 which is the minimum amount for the bid. This will be put on the agenda for the next Committee of the Whole meeting for council consideration.

9. PROCLAMATION: Public Works Week May 19-25, 2024

Ald. Beck Read the proclamation declaring May 19-25, 2024 Public Works Week Gary Holm extended thanks to all members of the Public Works Department and their families for all their hard work throughout the year.

Motion by Ald., seconded by Ald. Solfa, to approve the proclamation as read. Motion carried 12 yea / 0 nay / 2 absent.

10. PROCLAMATION: National Safe Boating Week May 18-24, 2024

Ald. Beck read the proclamation declaring May 18-24, 2024 National Safe Boating Week.

Motion by Ald. Beck seconded by Ald. Wolff to approve the proclamation as read. Motion carried 0 yea / 0 nay / 0 absent.

Alderman Vogelsinger entered the meeting at 7:13 p.m.

There was no vote count taken for the proclamation.

Alderman Wolff said it’s extremely important to talk about this every year with the dam situation we have and the Fox River in town. There are safe boating guidelines available at the United States Coast Guard Auxiliary Website or the National Safe Boating Website. The proclamation was presented to Mike Jandacek from the U.S. Coast Guard. Mr. Jandacek stressed the importance of training, safety classes, wearing a life jacket and boating while sober.

11. PRESENTATION: Batavia Public Arts Initiative – Proposal for Murals on East Side of Batavia Government Center

Alderman Beck is a Conservation Foundation member. The Conservation Foundation would like to continue the discussion about the Art of the Fox program and how it connects communities to the beauty and diversity of the Fox River through art. This initiative is focused on public art with projects that are public and accessible to all. Bonnie Baumgartner, co-chair of Batavia Public Arts Initiative, said they have partnered with the Conservation Foundation to bring art to Batavia. The east side of the Jeffery D. Schielke Government Center would be a desired site location using the framed 7’ x 5” windows as a canvas for the murals. The goal is to have 8 murals, but the total number will be based on fundraising effort. They are asking the blessing of the City Council to pursue the project. Requests for designs & portfolios would be made, and a jury would select the mural designs. The mural designs would then be presented to City Council and HPC for approval.

The Conservation Foundation has budget to do ½ of them and plan to fundraise for the rest.

12. CHAMBER OF COMMERCE

Margaret Perreault, Chamber Director, named the new businesses that joined the Chamber and also highlighted upcoming events.

The Inspire Celebration was held on May 25, 2024, at Revelry 675. She thanked all who came out and celebrated Dave & Marge Brown, Recipients of the Citizen of the Year Award; and the OLE Business Recipients. A video was shown that showcased the Community Impact Award Winners – Flag Day Patriotic Organization.

Marty Callahan, a member of Fox Valley Patriotic Organization, discussed upcoming events at the Flag Day Memorial on June 14th and June 15th. The organization has partnered with Fully Promoted in St. Charles for promotional gear and clothing. These items can be purchased on their online store.

13. WAIVE FORMAL BIDDING: Motion to Waive Formal Bidding for Resolution 2024-069- R

Motion by Ald. Wolff, seconded by Ald. Solfa, to approve the waiver as presented. Motion carried 13 yea / 0 nay / 1 absent.

This is for conduit installation that will be reimbursed that didn’t go out for formal bidding.

14. RESOLUTION 2024-069-R: Approving Contract with IHC for 12kV Conduit Installation (SKA 4/117/24)

Motion by Ald. Wolff, seconded by Ald. Solfa, to approve the resolution as presented. Motion carried 13 yea / 0 nay / 1 absent.

15. Ashton Ridge Subdivision – 1000 and 1100 McKee Street and 301 North Van Nortwick Avenue

a. ORDINANCE 2024-035: Amending the Land Use Map of the Comprehensive Plan .

Motion by Ald. Wolff, seconded by Ald. Solfa, to approve the resolution as presented. Motion carried 11 yea / 2 nay / 1 absent. (Nay votes Alderman Malay & Alderman Beck)

b. ORDINANCE 2024-036: Amending the Official Zoning Map to Rezone Property to the R1H and $3 District and to Add a Planned Development Overlay District to the Official Zoning Map

Motion by Ald. Wolff, seconded by Ald. Solfa to approve the resolution as presented. Motion carried 11 yea / 2 nay / 1 absent. (Nay votes Alderman Malay & Alderman Beck)

c. RESOLUTION 2024-066-R: Approving the Preliminary Plat of Ashton Ridge Subdivision

Motion by Ald. Wolff, seconded by Ald. Solfa, to approve the resolution as presented. Motion carried 11 yea / 2 nay / 1 absent. (Nay votes Alderman Malay & Alderman Beck)

d. RESOLUTION 2024-067-R: Notice of Decision for Tree Preservation

Motion by Ald., seconded by Ald., to approve the resolution as presented. Motion carried 13 yea / 0 nay / 1 absent.

16. RESOLUTION 2024-073-R: Authorizing Execution of the Amended Notice of Intent to Aard for the 2023/2024 Lead and Galvanized Steel Water Service Line Replacement Project to Five Star Energy Services, LLC (JPC 4/29/24)

Gary Holm stated this step is needed for the Illinois Low Interest Loan. This is a notice to intent to award not notice to award. Merely an administrative step in the process.

Motion by Ald. Solfa seconded by Ald. Wolff, to approve the resolution as presented. Motion carried 13 yea / 0 nay / 1 absent.

17. ADMINISTRATOR’S REPORT

We have received and distributed 500 reusable bags and have order another 500. They will be available at the Farmer’s Market. April 29th town hall was held for Mahoney Creek foam release that occurred on March 18th. We are waiting for the IEPA for results. Fire Department consultant working on staffing study. Public Works has moved back planters and benches on North River Street. Union & Water St. construction will be ongoing when Quarry opens. No permit issued yet by IDOT for Road diet, so we will be contracting with Andy Frain for crossing guard services by the Quarry.

22. MAYOR’S REPORT

Mayor passed out reusable bags to the City Council members. Mayor has had a lot of feedback (positive) from the community, especially senior citizens. Immediately west of Batavia Kane County Forest Preserve is buying approximately 1600 acres of farmland. This land will be off the tax rolls since no housing will be allowed on it. The biggest impact of this will be on the school district – mostly in Batavia. Fermi should have close to 2200 new jobs when the accelerator expansion is completed.
