City of Chillicothe Judicial Committee met Aug. 28.

Here are the minutes provided by the committee:

The Judicial Committee met on August 28, 2024 at 4:30 p.m., in the council chambers at City Hall.

Present: Chairman D. White, Alderperson Sharp, Alderperson Bredeman

Also Present: Mayor Hughes, Attorney Day, Office Manager Passage, Chief Cooper Chairman D. White called the meeting to order at 4:30 p.m.

PUBLIC COMMENT

None

PURPOSE

Model Ordinance - Regulating Public Camping -

Attorney Day discussed some language for a ordinance regulating public camping.

He explained that the ordinance will be regulating the use of public property.

He explained in the code currently there are hours limiting the use of the parks and the boat ramp area, however; they are different he suggested to make them the same. The consensus of the committee was to change the park hours from 10:30 p.m. - 6:00 a.m. to 10:30-5:00 a.m. and change the boat ramp area from 11:00 p.m. - 5:00 a.m. to 10:30 p.m. - 5:00 a.m.

A discussion was also held regarding establishing a fine. The consensus of the committee was to have the fine to be $25.00 within 12 months and an additional $50.00 added for each violation their after. The committee recommended that the attorney draft the ordinance and bring the ordinance back to the committee.

Residential EV Charging Stations - Establish Fee - Regulation

Attorney Day explained he has looked at other municipalities' regulations. A discussion ensued regarding establishing a fee for EV Charging Stations. She explained that she currently has one application for installing three EV Charging Stations at 328 S. Fourth. The code currently states that the electrical fee is $65.00 per application and the Building permit was calculated by using the section of all other building projects not well defined. Chairman D. White explained that the fee may be a staggered fee based on the amount of EV Stations being installed. The consensus of the committee was to have the office manager reach out to the inspectors to see what the potential inspections would be and work with the attorney to bring back a recommendation for a fee. Attorney Day will prepare a draft ordinance and bring back to the committee.

Review - Code - Number of Liquor Licenses

Chairman D. White presented the attached information regarding liquor licenses and gaming.

He explained the number of licenses available and the number issued. The consensus of the committee was to make no changes to the number of liquor licenses at this time.

Review - Code - Number of Gaming Licenses

Chairman D. White explained that also on the attached information there is a section regarding gaming licenses. Currently the code allows for 15 gaming licenses and at the present time there are two gaming licenses available. He proposed the following two questions:

Is there any reason to reduce the limit on the Class Q-(gaming) licenses?

Are we alright with any of the establishments being granted a Class Q-(gaming) license?

Mayor Hughes stated that he would like to have the Class Q reduced by eliminating the two Class Q (gaming) licenses. This would allow the council to decide by having to change the ordinance should an establishment want a class Q gaming license.

A discussion ensued. The consensus of the committee was to take to council to refer to the city attorney to draft an ordinance amending the code by changing the number of Class Q gaming licenses from 15 to 13.
