City of Eureka City Council met July 16.

Here is the minutes provided by the Council:

The Eureka City Council convened in regular session at the City Building on July 16, 2018, at 7:30 p.m. Mayor Scott Zimmer called the meeting to order and led The Pledge of Allegiance and then directed the City Clerk to call the roll. Present were Aldermen Hinnen, Teegarden, L. Klaus, Getz, Prather, Germann, Lind and Peterson. Also in attendance were Lynn Hinnen, Treasurer; Marilyn Walter, City Clerk; Melissa Brown, City Administrator; Rusty Klaus, Director of Public Works; and Chief Alex Collinge.

Moved by Hinnen, second by Prather, to approve the minutes of the July 2, 2018, regular meeting of the City Council and the minutes of the Special Council meeting on July 12, 2018. Passed on roll call vote Hinnen, Prather, Teegarden, L. Klaus, Getz, Germann, Lind and Peterson all voting Aye.

Moved by Teegarden, second by Prather, to approve the Treasurer’s Report as presented for the month ending June 30, 2018. Passed on roll call vote with Teegarden, Prather, Hinnen, L. Klaus, Getz, Germann, Lind and Peterson all voting Aye.

The Mayor asked for public comments on any action to be taken on Agenda items. There were none.

Moved by Prather, second by Germann, to approve and pay the bills as the City’s obligation in the amount of $63,135.46. Passed on roll call vote with Prather, Germann, Hinnen, Teegarden, L. Klaus, Getz, Lind and Peterson all voting Aye.

Public Hearing for consideration of recommendation from Eureka Planning and Zoning Commission to accept amendments to the 2014 Eureka Comprehensive Plan Future Land Use maps. The Mayor explained the need for dealing with the residential area of the City. The City has lost one planned subdivision. Walnut Grove Estates II was vacated by the developer. This would have been a 30+ parcel subdivision. So commercial use does not encroach on areas that are ideal for residential, this needs to be considered.

Moved by Prather, second by Hinnen, to approve amendments to the 2014 Eureka Comprehensive Plan Future Land Use maps. Passed on roll call vote Prather, Hinnen, Teegarden, L. Klaus, Lind and Peterson all voting Aye. Getz and Germann voted Nay.

Moved by Hinnen, second by Lind, to approve Ordinance 18-10, an ordinance annexing territory to the City of Eureka – Martha Lewis at 721 N. Main Street. Passed on roll call vote with Hinnen, Lind, Teegarden, L. Klaus, Getz, Prather, Germann and Peterson all voting Aye. Moved by Hinnen, second by Prather, to approve Ordinance 18-11, an ordinance annexing territory to the City of Eureka – Teresa Germann at 723 N. Main Street. Passed on roll call vote with Hinnen, Teegarden, L. Klaus, Getz, Prather, Lind and Peterson all voting Aye. Germann abstained.

Moved by Hinnen, second by Lind, to approve Ordinance 18-12, an ordinance annexing territory to the City of Eureka – Aaron and Krista Bergthold at 725 N. Main Street. Passed on roll call vote with Hinnen, Lind ,Teegarden, L. Klaus, Getz, Prather, Germann and Peterson all voting Aye.

Moved by Hinnen, second by Teegaraden, to approve Ordinance 18-13, an ordinance annexing territory to the City of Eureka – John D. and Julianna J. Herreid at 729 N. Main Street. Passed on roll call vote with Hinnen, Teegarden, L. Klaus, Getz, Prather, Germann, Lind and Peterson all voting Aye. the City of Eureka – Lyndell L. Lea.therman Et Al at 1012 S. Main Street. Passed on roll call vote with Hinnen,

L. Klaus, Teegarden, Getz, Prather, Germann, Lind and Peterson all voting Aye.

Moved by Hinnen, second by Prather, to approve the bid for the 2018 Sewer Lining Project. The engineer’s estimate was $75,208.00 and the low bid was $71,671.00 from Hoerr Construction Inc. Passed on roll call vote to award the contract to Hoerr Construction Inc. with Hinnen, Prather, Teegarden, L. Klaus, Getz, Germann, Lind and Peterson all voting Aye.

The Mayor discussed property procurement. Moved by Prather, second by Hinnen, to discuss the purchase of property at 209 Mill Street. All voted Aye. The Mayor explained that this has been discussed in Executive Session by the Administration Committee. He noted that the building on the property can be used for the salt shed and for other City usage. The property can accommodate our gravel. The Mayor would like permission to negotiate for this property. Tim Martin, the owner, is asking $150,000. The owner purchased it for $135,000. The building is 120 x 40 feet. Rusty explained some of the changes that would need to be made to the building. Equipment could be stored in a part of the building. The water tower is next to this property. Discussion was held on availability of money, need, negotiations, etc. Prather moved, L. Klaus second, to negotiate the purchase of this property. Prather, L. Klaus, Hinnen, Teegarden, Getz, Lind, Peterson voted Aye. Germann voted Nay.

Committee Reports:

Chairman Prather of the Budget Committee: No report

Chairman Getz of the Administration and Personnel Committee: No report

Chairman Hinnen of the Enterprise Committee: Rusty gave an update on the north sewer line installation. It is all in. Testing has to be done yet. Restoration will be done soon. The project was under budget.

Chairman Hinnen of the Maintenance Committee: No report

Chairman Lind of the Public Safety Committee: Lind welcomed Chief Collinge back after the birth of their son. Job well done at the Fourth of July celebration. Collinge noted that he appreciates Kent McCanless of ESDA and the great work and good relations. He thanked all of the volunteers who helped at the Fourth of July. Starcom radio training will be held soon. There will be a demo this week.

Chairman Germann of the Park and Recreation Committee: The Fourth of July celebration went well.

There were lots of people in town and at the Lake for the vendors, band concerts, bouncy houses, meals, etc. Melissa thanked all who helped prepare and serve in the heat. This weekend are the kayak races and obstacle course. Hope Fest (formerly Relay for Life) is also this weekend at the Lake. Disc golf will be August 9-12. Alderman Peterson expressed thanks to Melissa for all of her work on this celebration. Bryant Ruder organizes the parade each year. It was a long parade. The Sportsmen’s Club fixed breakfast at the Lake on the Fourth.

There is a nice mural on back of the Eureka Lake sign. Dawn Maloney has organized persons to help with this. The artist will soon be putting the last coat of finish on the art work.

Chairman Teegarden of the Economic Development Committee: No report

Chairman Mayor Zimmer of the Liquor Committee: No report

New Business: None

Public Comments and Questions: Wendy Getz, 102 Sunny Lane, asked if she would get reimbursed for water/sewer bills being paid when she had a septic. When she bought the house, she was apparently not told she was on septic and not on City water and sewer. This has happened at other times, and we have not reimbursed the home owners. At the time of the sale of the home this should have been disclosed.

The new electronic sign for City of Eureka located by the water plant is not ready at this time. The software needs to be learned and must be installed near the sign. It will be at Rusty’s office. The sign will display public education information and display local free activities. There will not be advertising. The police department has rules for use of the sign.

The Mayor noted that at future meeting we must remember that when speaking or expressing our opinions that we are elected to represent the City of Eureka not our own agendas.

There being no further business to come before the Council the meeting adjourned at 8:40 p.m.
