City of East Peoria Zoning Board of Appeals met June 12.

Here are the minutes provided by the board:

The meeting was called to order at 6:00PM

Attendees: Gina Driscoll, George Whitman, Don Tippet, John Broshears, Michael Bruner, Tim Kelly Absent:

Minutes from the May meeting were motioned for approval by Tim Kelly and seconded by Michael Bruner. The motion passed 6-0.

Case 23-SU-16 Petition of Antonio Cocchi for a Special Use to permit a Smoke (Vape) Shop on property located at 1818 Meadow Avenue, 05-05-02-103-001.

The petitioner, Antonio Cocchi, spoke on behalf of the proposal. He told the board that he's new to the community and looking to open this location. He doesn't sell traditional smoking devices or tobacco – just vaping. He calls it "harm reduction" and is offering a less harmful option to traditional smoking. Don Tippet asked to confirm the location of the business - the former barber shop on the west end of the building. He also asked about parking spaces shown - which are 3 for the business. Gina Driscoll confirmed the location of the front door which is on the side of the building. Tim Kelly asked about hours of operation - between noon and 7pm, Monday through Sunday as there's no employees except for himself and his wife.

Case 23-SU-17 Petition of Keith & Donna Craig for a Special Use to permit an accessory structure inconsistent with Title 5, Chapter 6 of the East Peoria City Code on property located at 300 Walnut Drive, 05-05-01-200-033.

The petitioner, Keith Craig, spoke on the project. The proposal here is to allow a large accessory structure. He has quite a bit of equipment that he'd like to build an additional accessory structure to house all of it. The proposal is to construct a 70 x 100 building.

Don Tippet asked to confirm the colored photo that was given but the petitioner plans to construct it with a cedar exterior but it will follow the proposed style. For this case, only the size is of concern for the ZBA as it's well in excess of the 1,250 sf requirement. Gina Driscoll clarified the request for those in the audience and online.

Case 23-SU-18 Petition of Rayman Kull for a Special Use to permit outdoor storage of materials on property located just west of 4200 E. Washington Street, 01-01-23-210-008, 012, & 013 (part of).

Mr. Kull presented his request to develop a recently acquired 18 acre parcel to expand his business. The Special Use is for the proposed outdoor storage area needed for the expansion. The set-up would be similar to what they already have at their current location - just expanded some.

George Whitman asked about the unpaved surface being proposed. Mr. Kull indicated the surface would be treated to minimize dust. Gina Driscoll asked about events they will be hosting. Mr. Kull indicated they will offer classes on water feature landscaping for both contractors and private parties.

Case 23-R-19 Petition of Diane Ginther to rezone property from B-3 to R-2 located at 2487 Washington Road, 02- 02-30-100-001.

Diane Ginther spoke on behalf of the proposal. She would like to rezone the property to residential to allow for it to be sold to an interested party that would like to use it for a home. Don Tippet asked for clarification regarding the structures existing on the property.

Case 23-SU-20 Petition of Robert & Tina Frederick for a Special Use to permit a pool and privacy fence in the required front yard on property located at 114 Glenridge Drive, 05-05-09-210-013.

Robert and Tina spoke on behalf of the proposed project. They are requesting a Special Use to place a pool and a privacy fence because of their small lot and limited rear yard. They were issued a permit in error for the pool and the fence but didn't realize it was an issue until a code violation notice that was issued for a trailer on the grass. Gina Driscoll asked about the trailer that was on the grass as well as the tree. The tree will stay but the trailer will be gone. Don Tippet asked to clarify the lot line placement.

Deliberations:

Case 23-SU-16

After deliberations and findings of fact, Michael Bruner motioned, and Tim Kelly seconded to recommend approval of the proposed Special Use. The board voted 6-0 to recommend approval as presented.

Case 23-SU-17

After deliberations and findings of fact, George Whitman motioned, and Don Tippet seconded to approve the proposed Special Use. The board voted 6-0 to recommend approval as presented.

Case 23-SU-18

After deliberations and findings of fact, Michael Bruner motioned, and Tim Kelly seconded to approve the proposed Special Use with the condition that an unpaved surface be permitted to be installed and maintained in areas where storage bins are located and not open to public access as per the site plan. The board voted 6-0 to recommend approval of the Special Use as presented.

Case 23-R-19

After deliberations and findings of fact, Tim Kelly motioned, and Don Tippet seconded to approve the proposed rezoning. The board voted 6-0 to recommend approval as presented.

Case 23-SU-20

After deliberations and findings of fact, Don Tippet motioned, and Tim Kelly seconded to approve the proposed Special Use with the condition the fence be placed not closer than the side lot line (approx. 10' from the back of the curb) and not in front of the house's front plane as per the site plan. The board voted 6-0 to recommend approval as presented.

Gina Driscoll introduced Brad Brewer, Planning & GIS Coordinator for the City, and mentioned Troy Sams will be joining the board next month.
