City of East Peoria Liquor Control Commission met May 20.
Here are the minutes provided by the commission:
Mayor Kahl called the Special Meeting of the Liquor Control Commission of the City of East Peoria, Illinois to order at 4:30 P.M. with proper notice having been given.
Upon the roll being called the following answered present: Commissioner Mark E. Hill, Commissioner Seth D. Mingus and Mayor John P. Kahl.
Absent: None.
Mayor Kahl gave an overview of the hearing and the reason for the hearing. City Attorney Kateah McMasters explained that the city has received a stock certificate, which does not show a legal transfer that Ms. Vanessa Godinez no longer owns five percent or more of the corporation. Mary Hutchings and Bradley Biggs representing Sorrentino Investments Inc. were present. Ms. Hutchings presented the Liquor Control Commission with a copy of Special Meeting Minutes from the meeting that occurred the day before and stock certificates. See attached.
Mayor Kahl asked for comments from the audience. There was no response.
Motion by Commissioner Mingus, seconded by Commissioner Hill; Mr. Mayor I move that a closed meeting or session of the Liquor Control Commission of the City of East Peoria be held at this time during the Special Meeting and that this special meeting be in recess until the conclusion of such closed session with the following matter or matters according to exceptions provided in the “Open Meetings Act” (5 ILCS 120/1 et. Seq.) and specified as follows to be discussed during the closed session:
Section 2(c)(4) - Evidence or testimony presented in open hearing to a quasi-adjudicative body which prepares and makes available for public inspection a written decision setting forth its determinative reasoning pursuant to 5 ILCS 120/2(c)(4)
Yeas: Commissioners Hill and Mingus and Mayor Kahl.
Nays: None.
Mayor Kahl declared the motion carried.
The East Peoria Liquor Control Commission recessed into closed session at 4:37 p.m.
The East Peoria Liquor Control Commission reconvened the Special Meeting at 5:02 p.m. with Commissioners Hill and Mingus and Mayor Kahl present.
Mayor Kahl explained that the Liquor Control Commission of the City of East Peoria is requiring submission of documentation necessary to show that Vanessa Godinez no longer holds five percent or more stock in the corporation within 72 hours of the current meeting. The necessary documentation could be in the form of a stock power or stock purchase agreement or other documentation sufficient to provide that Ms. Godinez no longer holds five percent or more stock in the corporation. If sufficient documentation is not provided within 72 hours, Sorrentino Investments, Inc. will face an automatic suspension. Mayor Kahl explained that a written order would be provided regarding the decision of the Liquor Control Commission of the City of East Peoria.
Mayor Mingus asked for any questions or comments from the audience. There was no response.
Motion by Commissioner Mingus, seconded by Commissioner Hill; I move that we adjourn the meeting.
Yeas: Commissioners Densberger and Mayor Mingus.
Nays: None.
Mayor Mingus declared the motion carried and the meeting adjourned at 5:04 P.M.
