City of East Peoria City Council met Oct. 1.

Here are the minutes provided by the council:

The Regular Meeting of the City Council of the City of East Peoria, Illinois was called to order by his Honor Mayor John P. Kahl presiding at 6:00 P.M. with proper notice having been given.

Upon the roll being called the following answered present: Mayor John P. Kahl, Commissioner Daniel S. Decker, Commissioner Mark E. Hill, Commissioner Seth D. Mingus, and Commissioner Michael L. Sutherland.

Absent: None.

The invocation was given by Commissioner Hill.

Mayor Kahl led the Council and the audience in the pledge of allegiance to the flag.

Motion by Commissioner Mingus, seconded by Commissioner Decker; Mr. Mayor, I move that the minutes of the Regular Meeting held on September 17, 2024 and the minutes of Closed Meeting/Executive Session held on September 17, 2024 be approved as printed.

Yeas: Commissioner Decker, Hill, Mingus, Sutherland, and Mayor Kahl.

Nays: None.

Mayor Kahl declared the motion carried.

Mayor Kahl read the proclamation and proclaimed October 6-12, 2024 as “Fire Prevention Week.” Mayor Kahl thanked the Fire Department and stressed the importance of having smoke alarms in homes. Commissioner Mingus presented the proclamation to Fire Chief Bobby Zimmerman. Fire Chief Zimmerman asked everyone to check the battery and push the button on smoke detectors to make sure they work. Oct 13 at 2:00pm at Fire Station 2 is the Annual Memorial Ceremony honoring fallen firefighters followed by an open house. Fire Chief Zimmerman explained that Fire Department is ere to assist, and if anyone is in need of a smoke alarm, please contact the Fire Department.

Mayor Kahl proclaimed October 2, 2024 as “Energy Efficiency Day.” He read the proclamation and presented it to Commissioner Hill. Commissioner Hill recommended checking on things in one’s home to make it more energy efficient.

Mayor Kahl explained that the City Council will be receiving and filing the Illinois Department of Transportation Compliance Review #73 covering receipt and disbursement of Motor Fuel Tax funds by the City for the period beginning January 1, 2023 and ending December 31, 2023. City Clerk Morgan Cadwalader explained that everything appears to be in order in the paperwork received.

Mayor Kahl stated if there was anyone in the audience who wanted to speak on any items on the agenda to come to the podium and state the matter or matters to be discussed. There was no response.

CONSENT AGENDA ITEMS BY OMNIBUS VOTE:

Mayor Kahl asked if any Commissioner wished to remove any items from the Consent Agenda for discussion. There was no response.

Motion by Commissioner Hill, seconded by Commissioner Decker; Mr. Mayor, I move to adopt a consent agenda consisting of items numbered 1 through 7 as listed on the agenda for this meeting to be considered by omnibus vote.

Item Number 1 - Adoption of Resolution Number 2425-065 - Resolution to Approve Payment of the Schedule of Bills Listed on Schedule Number 10 in the amount of $2,961,844.87.

Item Number 2 – Adoption of Ordinance Number 4811 on its Second Reading – (AN ORDINANCE AUTHORIZING A SPECIAL USE FOR OUTDOOR DISPLAY OF VEHICLES ON PROPERTY LOCATED AT 290 S. MAIN STREET IN THE CITY OF EAST PEORIA, TAZEWELL COUNTY, ILLINOIS.)

Mayor Kahl declared the motion carried.

Motion by Commissioner Hill, seconded by Commissioner Mingus; Mr. Mayor, I move you that Items numbered 1 through 7 listed on the Consent Agenda be hereby approved and adopted, the items numbered 2 through 7 having been read once by their title and having laid on the table for no less than one week for public inspection be adopted as presented.

Mayor Kahl declared the motion carried and the items adopted by omnibus vote designation.

Resolution No. 2425-064 by Commissioner Hill; RESOLUTION AUTHORIZING THE SELLING PROCESS FOR CITY-OWNED SURPLUS REAL ESTATE LOCATED AT 1654 MEADOW AVENUE IN EAST PEORIA

WHEREAS, the City has acquired title to a parcel of real estate located at 1654 Meadow Avenue within the City of East Peoria through the abandonment provisions of the “Unsafe Property” Division of Article 11 of the Illinois Municipal Code (65 ILCS 5/11-31-1, et seq.), and this parcel is legally described in Exhibit A and depicted in Exhibit B, attached hereto and incorporated by reference (hereinafter the “Property”); and

WHEREAS, the City has determined that the Property is surplus public real estate owned by the City, and the City considers the Property to be excess Property and unnecessary for City use or City purposes; and

WHEREAS, the City seeks to sell the Property pursuant to the process set forth under Section 11- 76-4.1 of the Illinois Municipal Code (65 ILCS 5/11-76-4.1), which provides for the appraisal of the Property by a certified or licensed appraiser and then the sale of the Property by City Officials, by a local licensed real estate agency, or by public auction for no less than 80% of the appraised value; and

WHEREAS, the Property is further described by the parcel’s current zoning classification, size, and use in Exhibit A; and

WHEREAS, the City Council hereby finds that it is in the best interests of the City to sell the Property such that the Property can be developed and put to use by an interested purchasing party;

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF EAST PEORIA, TAZEWELL COUNTY, ILLINOIS, THAT:

Section 1. The above recitations are found to be true and correct.

Section 2. The Property, after obtaining an appraisal of the Property by a certified or licensed appraiser, is hereby directed to be sold by any process set forth under Section 11-76-4.1 of the Illinois Municipal Code for no less than 80% of the appraised value.

Section 3. City Officials are hereby authorized to execute any documents necessary to initiate the sale or transfer of the Property and to negotiate the terms of such sale or transfer of the Property to an interested purchasing party. The terms of such sale or transfer of the Property shall include payment by the purchasing party of the City’s costs, including, but not limited to, the cost of the appraisal and title policy (if requested by buyer), recording fees, and City attorneys’ fees in the amount of five hundred dollars ($500.00); together with the standard real estate agent commission rate if listed by a local real estate agency.

Section 4. The City Clerk is hereby authorized and directed to publish this Resolution, and any exhibits attached hereto (excluding Exhibit B) immediately upon the passage of this Resolution by the City Council in a daily or weekly newspaper circulated in the City of East Peoria.

Section 5. City Officials, in their discretion, are hereby authorized to withdraw the Property from the sale or transfer process for any reason they deem necessary or appropriate.

Motion by Commissioner Hill, seconded by Commissioner Decker; Mr. Mayor, I move that Resolution No. 2425-064 be adopted as presented.

Commissioner Hill explained that the city is selling property located at 1654 Meadow Avenue that has a building on the property. The city will be acquiring an appraisal in the near future.

Yeas: Commissioners Decker, Hill, Mingus, Sutherland, and Mayor Kahl.

Mayor Kahl declared the motion carried and Resolution No. 2425-064 be duly adopted as presented.

Resolution No. 2425-062 by Commissioner Hill; RESOLUTION ESTABLISHING MORATORIUM ON ISSUANCE OF SPECIAL USE PERMITS AND LICENSES FOR SMOKE AND TOBACCO SHOPS IN THE CITY OF EAST PEORIA

WHEREAS, in September 2022, the City Council established regulations governing smoke and tobacco shops in the City of East Peoria as set forth in Chapter 35 of Title 3 of the East Peoria City Code (“Smoke and Tobacco Shops”); and

WHEREAS, in addition to the regulations for Smoke and Tobacco Shops set forth in Chapter 35 of Title 3, a special use is also required to maintain a Smoke and Tobacco Shop in a B-2 Business District in the City pursuant to the applicable provisions in Title 5 of the City Code (“Zoning Regulations”); and

WHEREAS, the City has recently received requests to establish Smoke and Tobacco Shops in various commercials and redevelopment areas in the City that have created concerns raised by City Officials and adjacent businesses; and

WHEREAS, City Officials are looking to review and re-evaluate the process for granting special uses and licenses for Smoke and Tobacco Shops in commercial and redevelopment areas of the City to address these potential concerns; and

WHEREAS, it is in the best interests of the City to place a moratorium on the issuance of any special uses or licenses for Smoke and Tobacco Shops in the City as provided herein;

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF EAST PEORIA, TAZEWELL COUNTY, ILLINOIS, AS FOLLOWS:

Section 1. A moratorium is hereby declared and established on the issuance of any zoning or special use permits or licenses for Smoke and Tobacco Shops, or any other permits of any nature whatsoever, which would allow the use of property in B-2 or B-3 business district within the City of East Peoria for a Smoke and Tobacco Shop, as such Smoke and Tobacco Shops are defined under Chapter 35 of Title 3 of the City Code.

Section 2. The moratorium declared by this Resolution shall be effective October 1, 2024, and shall expire April 1, 2025, unless earlier terminated or hereafter extended by action of the City Council. Section 3. No person or entity shall operate a Smoke and Tobacco Shop in a B-2 or B-3 business district within the City of East Peoria during the moratorium established by this Resolution unless the Smoke and Tobacco Shops has been lawfully in operation in the City prior to the imposition of this moratorium.

Motion by Commissioner Hill, seconded by Commissioner Mingus; Mr. Mayor, I move that Resolution No. 2425-062 be adopted as presented.

Commissioner Hill commented on the city having rules and regulations regarding smoke and tobacco shops. This resolution is to place a moratorium on issuing new special uses or licenses to determine if there are any needed changes to the rules or regulations.

Yeas: Commissioners Decker, Hill, Mingus, Sutherland, and Mayor Kahl.

Nays: None.

Mayor Kahl declared the motion carried and Resolution No. 2425-062 be duly adopted as presented.

Resolution No. 2425-063 by Commissioner Mingus, seconded by Commissioner Decker; BE IT RESOLVED BY THE COUNCIL OF THE CITY OF EAST PEORIA, ILLINOIS that Resolution No. 2425-063 hereto attached, a Resolution Approving and Accepting Proposal from Commercial Irrigation Inc. for the EastSide Centre Water Irrigation Main Line Rerouting Project, be hereby approved. Mr. Mayor, I move you that this Resolution No. 2425-063 having been read once by its title and having laid on the table for no less than one week for public inspection, be adopted as presented.

Commissioner Mingus commented on the upgrades to the fields at EastSide Centre making them turf fields. This resolution is to reroute water irrigation lines to the soccer fields and other regular grass fields with the total cost being $21,252.57.

Yeas: Commissioners Decker, Hill, Mingus, Sutherland, and Mayor Kahl.

Nays: None.

Mayor Kahl declared the motion carried and Resolution No. 2425-063 be duly adopted as presented.

Mayor Kahl stated if there was anyone in the audience who wanted to speak on any items not on the agenda to come to the podium state the matter or matters to be discussed. There was no response.

Mayor Kahl then asked for comments from Council.

Commissioner Decker explained that cleanup week is next week, which is first full week of October. It should be on your normal garbage pickup day unless public works starts running behind. He commented on the rules and regulations regarding size and items allowed and not allowed. He asked residents to remember to keep your bicycles and other items that are not to be included in cleanup week far from the curb. He asked salvagers to not operate after dark or in an unsafe fashion. He also explained that it is only for City of East Peoria resident that have residential garbage pickup, so do not invite others from outside of East Peoria to place their items. This last week on Wednesday through Sunday was the Vietnam Traveling Memorial Wall in the Levee Park. The weather was beautiful, and there were a lot of volunteers that helped with setup, running the event, assisting people, and taking the wall down. He thanked those that volunteered to help, including city staff. He thanked the East Peoria Community Foundation for their help, as well as Mayor Kahl for going above and beyond, and the community for their support. He explained that there were many that visited the Wall.

Commissioner Hill commented on the electronic recycling event that is this Saturday at the Festival Building, the Fall bulb and Mum Sall on Saturday, the Beautification Commission Paul Peterson Bright Spot Winners, and a new Fall and Halloween Decorating Contest that will be held by the Beautification Commission. More information on all the events can be found on the City’s website.

Commissioner Sutherland explained that Springfield Road is coming along. It is being blacktopped and striped. He commented on ensuring that people have their address on their home that is easy to see for first responders. He commented on bath salts and kratom being dangerous drugs and problems.

Commissioner Mingus commented on the Fire Memorial Ceremony on October 13 at 2:00 pm at Fire Station 2 tat will be followed by an open house.

Mayor Kahl explained that this Thursday is the East Peoria Chamber of Commerce’s annual Octoberfest from 4:30 pm to 6:30 pm. He explained that it is free and open to the public. Friday, Oct 18 from 5p-8p is the annual Cops and Roders trunk or treat event. He commented on the Vietnam Traveling Memorial Wall and the benefits that it provides including healing for veterans and family and friends. He explained that the Penguin Project Honor Flight made a stop at the Wall as part of their full day of events that started at the Civic Center and included a stop at the Air Guard. Mayor Kahl commented on new features brought with the Wall were additional panels from 911 and citizens that lost their lives that day. There were also walls from more recent wars and conflicts. Mayor Kahl explained that it is recommended to bring back the Wall every 3 to 4 years and not yearly. He commented on the number of volunteers and thanked them for their hard work.
