City of East Peoria Zoning Board of Appeals met Jan. 13.

Here are the minutes provided by the board:

The meeting was called to order at 6:00 PM

Attendees: Gina Driscoll, George Whitman, Don Tippet, John Broshears,

Absent: Tim Kelly, Troy Sams, Michael Bruner

Minutes:

Minutes from the November meeting were motioned for approval by Don and seconded George. The motion passed 4-0.

Case SU-2024-020 Petition of Kent Londrie for a Special Use to allow an accessory structure inconsistent with City Code section 5-6-5 on property located at 106 Oakdale Road. P.I.N.: 02-02-19-410-007.

Kent explains the main goal is to put a camper and a truck, as well as other outdoor equipment in the building and get them out of the elements or off-site storage.

Don asked if the empty lot is where the new building will go. Applicant said yes. Don asked about lot size and Brad indicated the lot is 78' x 130'. Don asked what the distance from the front of the house to the lot line. Ty said it was about 40' to the lot line. The applicant also confirmed that a new paved driveway will be installed from the street to the new building.

George asked what the smallest sized building they could go to accomplish this goal. Applicant said since their workshop (garage) is so small, they need to find a new place to put their truck. George asked what the height of the building is, they said 16' celling and a 25' peak. George asked if the siding would look more like a Morton building, applicant said it would. George clarifies that since there are 2 14' foot doors that there really won't be a lot of steel on the front. George asked if there was something else the applicant could use instead of steel. Applicant said they could get a brick façade. George asked if they had discussed this with the neighbors. Applicant said yes. George asked Ty if this covers all of the code exceptions for accessory structures. Ty said the recommendation will need to touch upon all of the code exceptions and include them in the board's recommendations.

Gina asked if this structure would be closer to their existing house or their neighbors. Applicant said closer to the neighbors. Gina asked Ty if there was a potential problem with lot coverage. Ty does not anticipate this to be an issue. Gina asked if this structure is going to be so big that it would cause a shade or shadow on their neighbors' property. Applicant said they have discussed this with their neighbors and the neighbors said they were ok with it.

Case V-2024-006 Petition of Frontier Hospitality for a setback variance on property located along Conference Center Drive. P.I.N.: 01-01-29-300-015.

Rob Culp, on behalf of Frontier Hospitality, explains they need the setback to help raise the lot up and for grading and parking purposes. In addition the lot is unusually shaped which also drives the need for the setback

Don asks for clarification of 6.1 feet for the setback. Rob clarifies that he believes that if you include the back patio as part of the building then they would need the 6.1'. Don asked about the flood line. Rob said that if they had to move the building forward it would make parking in front of the building a challenge. Don asked if there were any concerns with the walking path behind the building. Rob said there were no concerns. Ty added that the developers actually see that as an amenity and will be connecting the property to the trail.

Case A-2024-010 Petition of the City of East Peoria to amend the East Peoria Levee Overlay District Plan.

Ty Livingston, on behalf of the city, explains that there were additional changes from the presentation in November. Ty explains that there is a desire to call out specific uses that the city would like to prohibit from this district. Specifically, smoke and tobacco shops, cbd stores, and cannabis use stores.

Don asks about light industrial, and warehouse uses. Ty clarified that they would like to prohibit warehouse uses but not large box stores. Don asked about car washes. Ty said that would fall under auto-oriented uses.

Gina asked what RV storage would fall under. Ty said it was something that could be identified but within B-3 any outdoor storage would require a Special Use.

Deliberations:

Case SU-2024-020 After deliberations and findings of fact, George Whitman motioned, and John Broshears seconded to approve the proposed Special Use approving the size, height, and number of accessory structures with the condition that a different façade be used instead of the sheet metal as well as pave the driveway. The board voted 4-0 to recommend approval, with conditions.

Case V-2024-006 After deliberations and findings of fact, Don Tippet motioned, and John Broshears seconded to approve the proposed variance as presented. The board voted 4-0 to recommend approval, as presented.

Case A-2024-010 After deliberations and findings of fact, John Broshears motioned, and Don Tippet seconded to amendment. the board voted 4-0 to recommend approval, as presented.
