City of Peoria Firemen's Pension Fund Board of Trustees met November 6.

                      Proceedings of a Special Meeting of the Board of Trustees of The

                                     Firemen's Pension Fund of Peoria, Illinois

A Special Meeting of the Board of Trustees of the Firemen's Pension Fund of Peoria, Illinois,

was held this date at City Hall, Room 404, 419 Fulton Street, Peoria, Illinois, at 11:30 A.M. with

proper notice having been given, for the purpose of conducting Firemen's Pension Fund

business.

                                                        Roll Call

Roll Call of the following members: Ball, Nichting, Phillips, Treglio, President Nieukirk - 5.

Absent: None.

Others present: Attorney Jim Dobrovolny of Reimer Dobrovolny & Karlson on behalf of the

Peoria Firemen's Pension Fund; Attorney Keith Karlson of Reimer Dobrovolny & Karlson on

behalf of the Peoria Firemen's Pension Fund; Attorney John Dundas of Hasselberg Grebe

Snodgrass on behalf of the City of Peoria; Attorney Kevin Day of Hasselberg Grebe Snodgrass

on behalf of the City or Peoria; Attorney Stephen Kelly of Stephen Kelly Law on behalf of the

Applicant; Applicant Angela Allen; Chief Deputy City Clerk Stefanie Tarr; and Court Reporter Jill

Bleskey of Advantage Reporting Service.

                                                      Invocation

A moment of silence was held in remembrance of those Firefighters who have served our

community.

                                                Regular Business

ITEM NO.1 CONTINUED PUBLIC HEARING to Discuss and Consider an APPLICATION

for DISABILITY - LINE OF DUTY for CAPTAIN ANGELA ALLEN to become

Effective the Day after the Last Day Paid by the City of Peoria based on her

Salary (including 8% longevity), which will be Determined Following a Final

Vote by the Board, and with a Request to Issue a Check for the Appropriate

Amount After the Meeting. Recommendation: Board to Take Action as

Deemed Appropriate.

A continued Public Hearing was held regarding the Application for Disability - Line of Duty for

Captain Angela Allen.

At the conclusion of the evidence and oral arguments, Trustee Nichting moved to go into

Executive Session pursuant to 2(c)(4) to discuss evidence or testimony presented in open

hearing, or in closed hearing where specifically authorized by law, to a quasi-adjudicative body,

as defined in this Act, provided that the body prepares and makes available for public inspection

a written decision setting forth its determinative reasoning; seconded by Trustee Ball.

Approved by roll call vote.

Yeas: Ball, Nichting, Phillips, Treglio, President Nieukirk - 5;

Nays: None

The Board adjourned into Executive Session at 4:09 p.m.

                                         Reconvening of The Board of Trustees

The Board Meeting reconvened at 5:39 p.m.

Roll Call showed the following Board Members physically present: Ball, Nichting, Phillips, Troglio,

President Nieukirk - 5. Absent: None.

Others present: Attorney Keith Karlson of Reimer Dobrovolny & Karlson on behalf of the Peoria

Firemen's Pension Fund; Attorney John Dundas of Hasselberg Grebe Snodgrass on behalf of the

City of Peoria; Attorney Stephen Kelly of Stephen Kelly Law on behalf of the Applicant; Chief

Deputy City Clerk Stefanie Tarr; and Court Reporter Jill Bleskey of Advantage Reporting Service.

Trustee Phillips moved to grant the Application of Line of Duty Disability for Captain Angela

pursuant to 40 ILCS 5/4-110; seconded by Trustee Troglio.

Approved by roll call vote.

Yeas: Phillips, Troglio, President Nieukirk - 3;

Nays: Ball, Nichting - 2.

Attorney Karlson said this would not be the final decision and order until a written order was

voted upon and approved at a properly noticed public meeting.

Trustee Nichting moved to direct the Court Reporter to prepare and distribute to the Board the

transcripts of the open and closed sessions of the Public Hearing; seconded by Trustee Ball.

Approved by roll call vote.

Yeas: Ball, Nichting, Phillips, Troglio, President Nieukirk - 5;

Nays: None.

Trustee Nichting moved to direct Reimer, Dobrovolny and Karlson to draft a final decision and

order; seconded by Trustee Phillips.

Approved by roll call vote.

Yeas: Ball, Nichting, Phillips, Troglio, President Nieukirk - 5;

Nays: None.

                                 Citizens' Opportunity to Address The Board of Trustees

It was determined that there were no citizens to address the Board of Trustees.

                                                               Adjournment

Trustee Phillips moved to adjourn the Special Firemen's Pension Board Meeting; seconded by

Trustee Troglio.

Approved by roll call vote.

Yeas: Ball, Nichting, Phillips, Troglio, President Nieukirk - 5;

Nays: None.

The meeting adjourned at 5:42 p.m.
