City of Chillicothe Judicial Committee met Jan. 15.

The Judicial Committee met on January 15, 2020, at 4:30 p.m., in the Council Chambers at City Hall.
Present: Chairman Braun, Alderman Bredeman, Alderman Sharp, Alderman Hughes, Mayor White, City Attorney Seghetti, Office Manager Passage.
Absent: Alderman Gould
Chairman Braun called the meeting to order at 4:35 p.m.
PUBLIC COMMENT

PURPOSE
RESOLUTION – ELECTRICAL AGGREGATION
Office Manager Passage presented the Electrical Aggregation resolution that was drafted by the City Attorney. The resolution gives the Mayor the ability to receive and review bids from time to time in consultation with the City’s consultant Good Energy, LP and to accept bids most beneficial to the City. The consensus of the committee was to bring the resolution to council for approval at the January 27, 2020 meeting.
RESOLUTION –GAS AGGREGATION
Office Manager Passage presented the Gas Aggregation resolution that was drafted by the City Attorney. The resolution gives the Mayor the ability to receive and review bids from time to time in consultation with the City’s consultant Good Energy, LP and to accept bids most beneficial to the City. The consensus of the committee was to bring the resolution to council for approval at the January 27, 2020 meeting.
AMENDMENT – SECTION 98-82 C SECOND METER
Office Manager Passage explained that in the City Code in Section 98-82 C states the following:
Purchase of meter and backflow prevention device. Upon approval by the superintendent of public works of the application for a second water meter, the applicant must purchase the second meter and a backflow prevention device from the city at a rate that will be established by the city council and kept on file for availability in the city collector’s office. She explained that the rate can change and there may not be time to take it to council to change what is on file, therefore she recommended that the language be changed to allow the rate to be what the current rate is at the time of purchase from the city’s supplier. A discussion was held, and the consensus of the committee was to amend the ordinance.
COMMERCIAL FENCE ORDINANCE
Mayor White explained currently the city does not have regulations regarding installation of a fence on commercial property. The code only addresses residential fences. The plan commission reviewed the fence ordinance and gave a recommendation. (see attached). The committee discussed the changes. Mayor White explained that there is a change in this proposed ordinance that changes the requirement of side yard fences in a residential zoning from four feet to six feet. He stated that most of the requests for a variance for fences in a residential district are requests are for six feet in a side yard.
After discussion, the consensus was to present the recommendations to the city council so it may be referred to the attorney for drafting and then back to the plan commission to hold a public hearing.
AMENDMENT TO CITY CODE – FIRE RELATED ORDINANCES
Office Manager Passage stated there are several ordinances that need updated due to the transition to the fire district. A discussion ensued regarding the needed updates. After discussion the consensus of the committee was to have the office manager send the sections that need revised to the attorney to draft the necessary changes.
C3 – SERVICE DISTRICT ZONING CHANGE
Mayor White explained that a potential business is looking at the old family dollar building to put a cabinet making shop with milling. However; the C3 Zoning does not allow the milling. A discussion ensued regarding changing the C3 zoning to allow milling or to change the C3 zoning to allow milling as a special use after a public hearing. He reminded that this change would be effective for any property that is zoned C3. After discussion, it was the consensus of the committee to have the attorney draft an ordinance to allow milling in a C3 zoning as a special use, which would require a public hearing. The ordinance would require the plan commission to hold a public hearing before the ordinance could be presented to the city council for approval.
ORDINANCE – PROHIBITING CANNABIS BUSINESS ESTABLISHMENTS
Office Manager Passage explained that the council approved an ordinance to allow cannabis dispensaries, however; the committee had asked the attorney to draft an ordinance to prohibit all other cannabis business establishments until June 1, 2020 to give the city time review the rules and regulations for other cannabis business establishments. That ordinance was drafted and ready to take to the council for approval. The committee discussed the drafted ordinance and the consensus of the committee was to present the ordinance at the January 27, 2020 council meeting for approval.
