City of Peoria Liquor Commission met Jan. 6.

A meeting of the City of Peoria Liquor Commission was held in Room 404, City Hall, 419 Fulton Street, Peoria, Illinois, on January 6, 2020, Chairman Miller presiding, with proper notice having been posted.
ROLL CALL:
Present: Chairman Michael Miller; Commissioners: Camille Coates, Steve Kouri II, Stephen Morris, Mike O’Brien - 5;
Absent: None - 0.
Others present: City Attorney Michael Toren; Liquor Investigator Kevin Slavens; Fire Engineer Charlie Perrin; Deputy Clerk Trina Bonds; media and concerned citizens.
I. CALL TO ORDER
Chairman Miller called the meeting to order at 3:30 p.m.
II. APPROVAL OF MINUTES
Commissioner Morris moved to approve the Minutes of the November 4, 2019, Liquor Commission Meeting, as outlined; seconded by Commissioner Coates.
Approved by roll call vote:
Yeas: Coates, Kouri, Miller, Morris - 4;
Nays: None;
Abstention: None.
III. LIQUOR SITE APPLICATIONS
Chairman Miller read the amendment to Section 3-57, which will be read at the beginning of every Liquor Commission Meeting.
“The Liquor Commission is a recommending body with respect to site approval. Our function is to determine if the location of an establishment is appropriate for the class of liquor license being requested and then make a recommendation to the City Council as to whether the application should be approved or denied. The City Council makes the final decision.
Under Section 3-57 of the Code of the City of Peoria any misrepresentation or false statement made to either this Commission or the City Council relating to the proposed business to be operated on the site can result in a denial of your liquor license; suspension and/or revocation of a license if already issued, and a fine of up to $1,000.”
20-01 Black Band, LLC

Requesting: Class B (restaurant, 50% food)
Subclass 3 (beer garden)
Christopher Ober, Owner, presented a Site Application for a Class B (restaurant, 50% food) Liquor License with a Subclass 3 (beer garden) at 1000 SW Adams.
In discussion with Chairman Miller, Mr. Ober said they planned to open for business in mid-March to early April. He said initially, their hours of operation would be Wednesday thru Sunday from 11:00 a.m. to 12 midnight. He went on to say that after approximately three months of operation, he said they would then change to be open seven days per week.
During discussion regarding the hours of operation of the beer garden, Liquor Investigator Slavens pointed out that the establishment could remain open until 1:00 a.m., but he said the beer garden could be closed earlier. Chairman Miller pointed out that in the requirements for a beer garden, it had to be enclosed with fencing.
In discussion with Commissioner Morris, Mr. Ober explained that they would be distilling a wide range of different products that would be all made on site.
Hearing no more comments or questions, Chairman Miller called for the motion.
Commissioner Morris moved to recommend approval of the Site Application for a Class B (tavern) Liquor License at 1000 SW Adams, with a Subclass 3 (beer garden), contingent upon the issuance of the Certificate of Occupancy; seconded by Commissioner Kouri.
Approved by roll call vote.

Abstention: None.
Chairman Miller stated this recommendation would be heard at the City Council Meeting to be held on Tuesday, January 28, 2020, at 6:00 p.m. and a representative of this establishment should be present at that meeting.
IV. WELCOME AND INTRODUCTION
New City Attorney Michael Toren was welcomed and introduced to the Liquor Commission.
V. OLD BUSINESS
MOVIE THEATER ORDINANCE FOLLOW-UP
A brief discussion was held in regard to the proposed Movie Theater Ordinance that was discussed at the November Liquor Commission Meeting. Chairman Miller said it was his understanding that the Legal Dept. would work with the movie theater representatives to make amendments to the draft ordinance
and send it back to the City Council. He then said once an ordinance was approved, the Liquor Commission would review Site Approval applications.
City Attorney Toren said he would follow up on the status of the Movie Theater Ordinance with Interim Corporation Counsel Chrissie Peterson and report back to the Liquor Commission.
VI. CITIZEN’S OPPORTUNITY TO ADDRESS THE LIQUOR COMMISSION
There were no citizens who wished to address the Liquor Commission.
VII. NEXT SCHEDULED MEETING
The next scheduled regular meeting of the Liquor Commission is Monday, February 3, 2020.
VIII. ADJOURNMENT
Commissioner Morris moved to adjourn the meeting; seconded by Commissioner Kouri. Approved by viva voce vote.
